Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you", or "your") and Swift Site Solutions ("Swift Site Solutions", "we", "us", or "our"), regarding your use of our website design, development, hosting, and maintenance services.

By requesting a demo, subscribing to our services, or making a payment, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you may not use our services.

Service Description

Swift Site Solutions provides professional website design, development, hosting, and ongoing maintenance services on a subscription basis. Our services include:

  • Custom website design and development
  • Mobile-responsive design optimized for all devices
  • Web hosting on fast, secure servers
  • SSL certificate and security features
  • Ongoing technical support and maintenance
  • Monthly content updates (as per your plan)
  • Performance monitoring and optimization
  • Regular backups and security updates

Service Delivery Timeline: We aim to deliver your demo website within a week of receiving your project requirements. Simpler sites are often faster; larger or more complex builds may take a little longer. Upon approval, we will launch your live website within 24-48 hours.

Payment Terms

Upfront Cost

A one-off build fee from £199 applies to the standard plans, quoted for your project and agreed in writing before work begins. The monthly fee covers hosting, maintenance and management thereafter. Projects requiring functionality beyond the standard build — including e-commerce, customer login areas, payment gateways, and advanced booking systems — are quoted bespoke, with the price agreed in writing before work begins.

  • Nothing is payable before work begins on the standard plans
  • The monthly fee begins when your website goes live
  • For bespoke projects, payment terms will be set out in your individual quote

Monthly Fee

From the date your website goes live, a monthly fee applies to cover hosting, maintenance, and ongoing management:

  • Get Found: £50/month — hosting, SSL, backups, security updates, uptime monitoring, content updates, and email support
  • Get Seen: £100/month — everything above, plus Google Business Profile management, review monitoring and replies, photo updates, and business information maintenance
  • Never Miss a Job: £129/month for the first 3 customers, then £150/month — everything above, plus missed-call text-back, a shared inbox, website text widget, automatic quote follow-up, automatic Google review requests, service reminders, and a monthly report

A minimum term of 12 months applies from the date your website goes live. After the minimum term, the agreement continues monthly and may be cancelled with 30 days' written notice.

The monthly fee includes hosting. If the monthly fee is cancelled or lapses, hosting ends and your website will no longer be publicly accessible unless you arrange hosting elsewhere. See the Cancellation Policy below.

Payment Processing

  • Monthly fee payments are processed automatically on the same date each month
  • Payments are non-refundable except as required by law
  • We accept payment via credit/debit card, Direct Debit, or bank transfer
  • All prices are in British Pounds (GBP) and exclude VAT where applicable

Late Payments

If a monthly payment fails, we will notify you via email and attempt to process payment again. If payment is not received within 7 days:

  • Your website may be temporarily suspended
  • A £25 late payment fee may be applied
  • Continued non-payment may result in service termination

Cancellation Policy

Cancelling the Monthly Fee

A minimum term of 12 months applies from the date your website goes live. After the minimum term, you may cancel by providing 30 days' written notice to hello@swiftsitesolutions.co.uk. Cancelling within the minimum term requires payment of the remaining monthly fees for that term.

Upon cancellation, we will provide you with all website files, source code, and documentation. You can take these to any hosting provider you choose.

Important: Your monthly fee includes hosting. Once your notice period ends and payments stop, hosting ends and your website will no longer be publicly accessible. The files remain yours and we will hand them over, but you will need to arrange hosting elsewhere for the site to stay online. We will give you reasonable assistance in transferring your site to a new provider.

Our Right to Terminate

We reserve the right to suspend or terminate your service if:

  • You breach these Terms of Service
  • You fail to pay your subscription fee
  • Your website contains illegal content or violates our Acceptable Use Policy
  • You engage in abusive behavior toward our team

Ownership and Intellectual Property

Your Ownership

We cover the full cost of creating your website. The intellectual property, code, and design belong to you once the 12-month minimum term has been completed. The monthly fee covers hosting, maintenance, and ongoing management — not ownership.

You retain ownership of all of the following:

  • Website design, code, and structure (once the 12-month minimum term is complete)
  • Custom features and functionality we develop for you
  • Your business name, logo, and branding
  • Your written content and images you provide
  • Your customer data and business information

Important: Ownership of the files is separate from hosting. Because hosting is provided as part of your monthly fee, your website will only remain publicly accessible for as long as that fee is paid. If you stop paying, we will hand over your files, but the site will go offline unless you host it elsewhere.

Third-Party Content

You are responsible for ensuring you have the right to use all content (images, text, videos, etc.) you provide to us. We are not liable for any copyright or trademark infringement related to content you supply.

Service Level and Support

Uptime

We host on enterprise-grade infrastructure that targets 99.9% uptime. While we cannot guarantee uninterrupted service, we monitor your site continuously and work to resolve any downtime as quickly as possible. Scheduled maintenance is excluded.

Support Response Times

  • Email Support: Response within 24 hours (Monday-Friday, 9:00 AM - 6:00 PM GMT)
  • Critical Issues: We aim to respond within 4 hours for website downtime or security issues
  • General Inquiries: Response within 1-2 business days

Content Updates

All plans include ongoing content updates as part of your monthly fee, subject to fair use. This covers text changes, image replacements, price and opening hour updates, menu adjustments, and minor content additions — typically up to 2 hours per month.

Larger work — new pages, redesigns, new features, or integrations — falls outside the monthly allowance and is quoted separately at £50/hour. We will always confirm the cost with you in advance, and no chargeable work is carried out without your agreement.

Text Messaging (Never Miss a Job)

The Never Miss a Job plan includes the text messaging used by missed-call text-back, quote follow-up, review requests, and service reminders, subject to fair use. Fair use reflects normal usage for a single trade or local business.

Each account has a monthly messaging allowance set at a level that covers normal usage for a single trade or local business. If the allowance is reached before the end of the month, messaging pauses until you top it up or the allowance resets at the start of the next monthly cycle. Your website, Google Business Profile management, and every other part of your plan are unaffected.

We will let you know as you approach the allowance so you have the chance to top up before messaging pauses. Top-ups are optional and charged at cost — we will confirm the amount with you before taking any payment.

Scheduled Maintenance

We may perform scheduled maintenance with advance notice. We will make reasonable efforts to schedule maintenance during off-peak hours and minimize disruption.

Client Responsibilities

As a client, you agree to:

  • Provide accurate, complete information for your website
  • Respond to our requests for information or feedback in a timely manner
  • Provide content (text, images, etc.) that you have the legal right to use
  • Maintain a valid payment method for your subscription
  • Comply with all applicable laws and our Acceptable Use Policy
  • Notify us promptly of any issues with your website
  • Not attempt to access or modify server files or infrastructure without authorization

Limitations of Liability

To the fullest extent permitted by law, Swift Site Solutions shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from third-party services or integrations
  • Content or materials provided by you that infringe third-party rights
  • Downtime caused by factors outside our reasonable control
  • Any damages exceeding the total fees paid by you in the 12 months preceding the claim (or £500, whichever is greater)

Indemnification

You agree to indemnify and hold harmless Swift Site Solutions from any claims, damages, or expenses arising from:

  • Your breach of these Terms
  • Content you provide that infringes third-party rights
  • Your violation of any applicable laws or regulations
  • Your use of the website or services in an unauthorized manner

Acceptable Use Policy

You agree not to use our services to:

  • Host illegal, harmful, or offensive content
  • Distribute malware, viruses, or malicious code
  • Engage in spamming, phishing, or fraudulent activities
  • Violate intellectual property rights of others
  • Attempt to gain unauthorized access to systems or networks
  • Conduct activities that violate UK or EU laws
  • Harass, abuse, or harm others

Modifications to Services and Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email at least 30 days before they take effect. Your continued use of our services after changes become effective constitutes acceptance of the modified Terms.

We may also modify our services, features, or pricing with 30 days' notice. Existing clients will be grandfathered at their current pricing for the duration of any active project already in progress.

Data Protection and Privacy

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and UK Data Protection Act 2018.

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms.

Key data protection commitments:

  • We process your data lawfully and transparently
  • We implement appropriate security measures
  • You have rights to access, rectify, and erase your data
  • We will not sell your personal data to third parties

Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Dispute Process

In the event of a dispute, we encourage you to contact us first to resolve the matter informally. We are committed to working with you to find a fair resolution.

If we cannot resolve a dispute informally, you may have the right to refer the matter to alternative dispute resolution or the courts.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Swift Site Solutions regarding our services and supersede all prior agreements and understandings.
